Incoming orders for domain names undergo a preliminary review to ensure that the applicants are authorized, the requested designation is appropriate and not generic, and no unlawful use is intended. The BAKOM only examines the rights to the trademark, not the infringement of third-party rights. Accepted applications are published on www.nic.swiss for 20 days to allow for competing applications or comments. After this period, domain names are assigned if there are no objections. Otherwise, BAKOM will review the applications separately.
Incoming orders ("applications") undergo a summary preliminary review. This review checks whether:
1. the applicants belong to an authorized category,
2. the requested designation is objectively connected to the applicants and the intended use,
3. the designation is not reserved for another category of applicants,
4. the designation is not generic,
5. the intended use is not unlawful.
BAKOM only examines whether a right to the trademark exists that is connected to the application, and not whether third-party rights are infringed.
Every Tuesday, the applications accepted in the preliminary review are published for 20 calendar days on the registry operator’s website www.nic.swiss. All interested parties then have the opportunity to submit a competing application for a requested domain name or to submit comments via the reporting form on www.nic.swiss.
After the 20-day publication period expires, the assignment of domain names for which no comments or competing applications have been received takes place. Otherwise, BAKOM will handle the case separately.
